General terms and conditions of sale

The present General Terms and Conditions of Sale (the “Terms and Conditions”) are concluded between HARMANDI (“THE SELLER”) and any non-trading individual (“THE USER”) wishing to make a purchase on the site.
Before placing an order, the user declares that he/she has read the following provisions and expressly accepts the terms set out below.
Placing an order implies the user’s full and unreserved acceptance of the present Terms and Conditions. They constitute the sole contractual document binding on the parties, to the exclusion of any other document, prospectus, catalog or photograph, on any medium whatsoever, which are for information purposes only. The present General Terms and Conditions are available on the Site, where they can be consulted directly, and can also be communicated on request by telephone, e-mail or post.
The SELLER reserves the right to modify the General Terms and Conditions. They will be applicable as soon as they are put on line to all orders placed after that date.

CHILD PROTECTION

The purchase of Products is reserved for persons with the capacity to contract within the meaning of articles 1123 and 1124 of the French Civil Code.

PRODUCTS

The Products governed by these Terms and Conditions are those shown on the Website. They are offered while stocks last.

The SELLER endeavors to present photos of the items as faithfully as possible, but these remain non-contractual, as the nuances of color and the rendering of materials presented on the screen may differ from reality, depending on the lighting or resolution of the USER’S screen. The SELLER shall not be held liable for any errors or omissions in this presentation.

PRE-ORDER INFO

Why pre-order a model?

The advantage of a pre-order is that it allows you to reserve a product as a priority.
These items are often limited to very few copies, and some highly sought-after pieces are sold out even before they arrive in stock!

How reliable is the date of a pre-ordered product?

The manufacturer may postpone the release of a model. However, the shipping date indicated in the descriptions includes a wide reception time range (products are expected to arrive several days before).
Harmandi Ltd cannot be held responsible for any delays or cancellations by the manufacturer.
Payment for a pre-ordered product :

Pre-order cancellation :

If, in exceptional circumstances, the pre-order cannot be honoured, due to reduced production quantities compared with forecasts, release cancelled by the manufacturer, etc.,

The refund will be made directly to the credit card used to make the purchase.

For payment by PayPal:

The refund will be made directly to your PayPal account through which you made your purchase.

Delivery :

Products are dispatched once the pre-order has arrived in stock.
Product dispatch dates are given for information only and are communicated by Harmandi Ltd.

It is possible to group a pre-order item with items that are already in stock. Your entire order will be delivered only when the pre-order item is available on our premises.

Important information:

We are of course not responsible for any delays on the announced dates. If new dates are given, we will make sure to modify them as soon as possible on the product sheet.

THE OFFER

Product offers are valid as long as they are visible on the Site, subject to availability.
In the event of unavailability of a Product, the user will be informed as soon as possible. The user will be able to choose between a refund or wait for the seller to restock.

THE PRICE

Product prices do not include delivery charges (postage, packaging and parcel preparation in accordance with the amounts in force). The amount of delivery charges will be specified on the order form before the order is validated.
If one or more taxes or contributions, notably environmental, are created or modified, either upwards or downwards, this change may be reflected in the sale price of the Products on the Internet Site and on the various sales media.
However, the price may not be modified once the User’s order has been validated.

ORDERING

The USER places an order online.
The USER has the choice between creating an account on the seller’s site or ordering as a “Guest”, which avoids the creation of an account (in this case, the USER receives all useful information on the e-mail address he/she has chosen).
The data recorded by the SELLER when the order is placed constitutes proof of the transactions between the SELLER and the USER.
In certain cases, such as non-payment, incorrect address or other problems with the user’s account, the seller reserves the right to block the user’s order until the problem has been resolved.
Once the basket has been validated, the user must accept the General Terms and Conditions, choose the delivery address and method, and finally validate the payment method. This last step formalizes the sales contract between the seller and the user.
The seller will acknowledge receipt of the order as soon as it has been validated by sending an e-mail.

PAYMENT TERMS

The USER may pay for purchases either with PayPal or with SystemPay. By choosing payment via PayPal, the USER can pay without having to create an account or, if not, will be automatically directed to his PayPal account. Once the PayPal payment has been validated, the USER can complete his order on the Website.

PAYPAL:

Use PayPal to pay for your purchase. If you don’t receive your item, or it doesn’t match the seller’s description (different color, broken item, etc.), PayPal can refund you. This protection is free and valid in France and abroad (see conditions).

How do you go about it?

To report a dispute, log in to your PayPal account. You have 180 days from the date of payment. If the seller does not respond or if you do not find an amicable solution, you can transform the dispute into a claim within 20 days. By opening a claim, you are asking us to make a decision on your behalf. We will then review your case and verify your eligibility for a refund in accordance with our Terms of Use.

Terms and conditions

All items that can be shipped and are not prohibited by law can be covered. Here are some examples of cases where we will intervene: you bought a book but received a DVD, you bought a new item but received a second-hand one, you bought 3 items but received only 2, the item was damaged on delivery, important parts of the item are missing (not mentioned by the seller), you bought a genuine item but received a counterfeit. If the seller was accurate in his description but the item is not to your liking, Purchase Protection does not apply.

Program exclusions

Purchase Protection does not cover real estate, vehicles or items not authorized by our regulations (and generally prohibited by law). Payments for hand-delivered items and the sending of money between relatives are also not covered.

We protect your account

You are not responsible for unauthorized purchases made from your account if you report an eligible incident within 60 days. This means that in the event of unauthorized use of your account, we can reimburse you.
Refunds in the event of problems

In the event of an unauthorized transaction with your PayPal account, you are not liable for the purchase if you open a dispute within 60 days. If you have a problem with a seller, you can also ask us to intervene. If your purchase meets our Protection conditions, we will refund you.

DELIVERY

The seller ships products via the DPD carrier services for France. The seller ships its products within 48 hours following receipt of the order. However, the seller cannot guarantee the delivery time, as this depends on the carrier’s conditions.
The SELLER reserves the right to change the delivery method according to the contracts established by the carrier.
However, should these conditions change, the USER will not pay any additional charges in relation to his initial order.
In the event that the Product(s) cannot be delivered, it will be returned to the SELLER and it will be the USER’s responsibility to contact the SELLER to schedule a new delivery.

LEGAL WARRANTIES

Products are subject to the following legal warranty conditions: With regard to conformity: to the provisions of Articles L. 211-4, L. 211-5 and L. 211-12 of the French Consumer Code, which apply only to natural persons who are consumers and not professionals.
With regard to latent defects: to the provisions of Article 1641 of the French Civil Code and Article 1648 paragraph 1 of the French Civil Code.

COMMERCIAL WARRANTIES

The Products are guaranteed against any defect resulting from faulty material, manufacture or design.
The defect must be reported within 14 days of receipt of the Product. After 14 days, the warranty will not be applied.
Our warranty is excluded in the event of defects caused by:
– negligence, overloading or misuse of the product
– perforation of the product by an external object or element
– any use of the product other than that for which it was designed.

RETURN OF PRODUCTS

If, despite the best efforts of the SELLER to satisfy the USER, the USER is not satisfied with his or her purchase, in accordance with article L.121-20 of the French Consumer Code, the USER has a period of fourteen (14) days from the day after he or she takes possession of the goods to return the Product(s) ordered for an exchange or refund. The cost of returning the Product(s) shall be borne by the USER.
This right of withdrawal may not be exercised if the Product(s) has (have) clearly been used. Any damaged and/or opened product will be charged to the USER and will not be returned or exchanged.
The SELLER undertakes to reimburse to the USER who has exercised his right of withdrawal the sums paid as soon as possible and at the latest within fourteen (14) days following the exercise of the right of withdrawal.
In the event of a defect noted on the product upon receipt, the USER must contact customer service within a maximum of 14 days following the date of receipt of the package and provide photos of the damage noted. An exchange will then be proposed or a refund, if applicable.
The USER must contact the SELLER before returning the Products. Products must be returned in their original packaging to the address provided by the SELLER.

The USER will have to put his order number and name in evidence for a faster treatment.
The return for an exchange of a defective product will be in charge of the SELLER provided that the product is turned over in the 14 days following the date of reception of its goods. After 14 days, the product will not be returned or exchanged.
Once the product has been returned and STE HARMANDI has noted the defect, the return costs will be reimbursed by the SELLER, provided that the fourteen-day period has been respected. The customer must send a photo of the return slip or an invoice to be reimbursed.

LIABILITY – NOTICE

The SELLER undertakes to describe the products sold on the Website as accurately as possible.
The SELLER shall not be held liable in the event that the non-performance of its obligations is attributable either to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure as defined by French case law. The USER undertakes to comply with the instructions for use enclosed with the Product.

RETENTION OF TITLE

Products are sold under reservation of ownership: the SELLER retains ownership of the products until payment of the full price in principal, interest, costs and accessories.
Custody of the Products is transferred to the user upon delivery of the Products.
In the event of total or partial non-payment of the price on the due date for any reason whatsoever, by express agreement, the SELLER has the right, without prior formal notice, to physically repossess the Products at the user’s expense, risk and peril. Payment shall be deemed to have been made when the price is actually received.

INTELLECTUAL PROPERTY

All elements of the Website, whether visual or audio, including the underlying technology, are protected by copyright. Similarly, the trademarks, logos, designs and models featured on the Website are the exclusive property of the seller. Their disclosure shall in no way be construed as granting any license or right to use said trademarks and distinctive elements protected by copyright.
